The Supreme Court has ruled that a Pennsylvania High School violated the First Amendment rights of then-student Brandi Levy when the school suspended her for a vulgar Social Media rant.
Levy posted the rant while off-campus. She posted it after learning that she did not make the varsity cheerleading team. The post read..
F— School, f— softball, f— cheer, f— everything
The post was discovered by one of the school’s cheerleading coaches. Brandi was then suspended from participating in cheerleading for the entirety of her Sophomore year.
The Biden administration was in support of the school. The Justice Department also sided with the school. Luckily, the Supreme Court was not as authoritarian.
The Supreme Court ruled in favor of Brandi Levy.
In an 8-1 decision, the court ruled that there is a limit as to what schools can punish students for. The Court ruled that the Social Media posts did not interfere with the classroom at all, and that the school violated Levy’s First Amendment rights when they suspended her.
This is a massive blow to cancel culture. Students have been assaulted for their free speech for far too long. This ruling is a great step in the right direction.
In my opinion, the Supreme Court should have taken this ruling as far as the Federal Appeals Court did. They should have ruled that Schools have absolutely no right to punish students for anything they say.
The schools have no right to punish anybody for anything that happens outside of school. This is just common sense. This ruling leaves a slight opening for abuse, but closes a large majority of the abhorrent cases of persecution.
This ruling is a massive victory for Free Speech. The Supreme Court, though imperfect, continues to be the only entity with some semblance of Constitutionality. It may be a extremely slight semblance, but it’s a vast improvement over virtually everything else that I see coming out of Washington D.C.
